Do you know that in Ohio it is a felony to create, reproduce, advertise, buy, sell, publish, deliver, disseminate, display, exhibit, present, provide, photograph, film, develop, transfer, possess or even view pictures containing obscenity, sexual activity or nudity involving minors”? (ORC 2907.3210). A minor is any individual under 18 years of age. Sexting is the sending of sexually suggestive text messages or photographs by cell phone or other electronic devices. In the wrong circumstances, just opening an innocent looking text message can lead to unintended consequences for your children. It is a felony for your kids to receive naked pictures from other kids at school. It is a felony for your kid to share naked pictures he/she received. It is a felony for your kid to share a naked picture of himself or herself.
Juveniles can be charged with such felonies, and most charges qualify as a second degree felony in Ohio. Second degree felonies for minors may carry severe punishments, such as, a commitment to the Department of Youth Services, electronic monitoring, house arrest and possible removal from the home and placement in foster care. Your minor child could be labeled as a sex offender. Minor children who are 16 and 17 carry a mandatory sex offender classification.
A sex offender classification could make renting an apartment impossible, getting a job extremely difficult and cutting down the chance of getting into college.
It is important to talk to your children about the risks of sexting, as well as proper use of social media, internet usage and email precautions.
